Terms & conditions - Conveyancing & survey services

PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE
 

Distance selling – Conveyancing & Survey Services

Conveyancing Network complies with the distance selling regulations and as such we must inform you that our service begins immediately upon a payment being taken. No cooling off period or refunds can be given.

By giving Conveyancing Network your card payment details, or by making any other form of payment to Conveyancing Network, you agree to be bound by these Terms and Conditions.

Conveyancing & Survey - Supply Agreement

DEFINITIONS:
In this agreement, the following definitions shall apply

The Property: the property in respect of which a conveyancing transaction is being provided
Legal Fee: the amount that you are charged for the supply of conveyancing services
File Opening Fee: the proportion of your legal fee which is paid up front to Conveyancing Network     
File Management Fee: the proportion of your legal fee which is paid on completion
Credit/Debit Card Details: Details as provided by the Customer
We/Us: Conveyancing Network Ltd
You/The Client/The Customer : The owner/person acting on behalf of the owner of the property who issues instructions or payment to Conveyancing Network

Terms for supply of Conveyancing Services

  1. The customer shall provide us with all data required in order to open their conveyancing file and in some instances order searches.
  2. We shall open the conveyancing file promptly following receipt of payment (in cleared funds) of the applicable charges notified to the customer for supply of conveyancing services.
  3. You acknowledge that the file opening fee paid by you to us for supply of conveyancing services is non-refundable. 
  4. The file opening fee is transferable to a new transaction, should your original transaction not complete.
  5. You acknowledge that the file management fee is to be paid by you directly to your solicitor on completion of your conveyancing transaction.
  6. The legal fee is fixed and will not increase.
  7. The legal fee DOES NOT include other fees and costs such as SDLT fees, bank fees, insurance indemnity fees, data storage fees, stamp duty, Land Registry fees – PLEASE NOTE that this is not an exhaustive list of other fees/charges, however, these other fees/charges will be incorporated in your quote letter or notified to you by your solicitor.
  8. We shall not be liable for any delay in performing or failure to perform any of our obligations under these terms caused by any event outside our reasonable control (including Acts of God, staff illnesses, office closure and computer system failure).
  9. In no event shall we be liable to you under these terms for any of the following types of loss, whether arising in contract, tort (including liability for negligence), under statute or otherwise: (a) loss of business; (b) loss of revenue; (c) loss of profits; (d) loss of anticipated savings; wasted expenditure; (e) loss of goodwill; (f) corruption or destruction of data; or (g) any indirect or consequential loss, including any indirect or consequential loss of the types referred to in this paragraph 10.  In no event shall you raise any claim under these terms more than two years after the discovery of the circumstances giving rise to such claim.
  10. A person who is not a party to these terms shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce these terms but this shall not affect any rights or remedy of a third party which exists or is available apart from that Act.
  11. These terms shall be governed by and constructed in accordance with the laws of England and Wales and the parties hereby irrevocably submit to the exclusive jurisdiction of the courts of England and Wales. 
  12. Your order is an offer to purchase conveyancing services from us. You are responsible for ensuring that the information you provide to us (including, without limitation, your personal contact details, property description and payment details) is accurate and complete. We reserve the right to pass on any costs we reasonably incur if you fail to do this.  
  13. If you have a complaint about our service, please refer to our Complaints Procedure (a copy of which is available on request or otherwise available on our website at www.conveyancingnetwork.co.uk).
  14. You agree that we may collect, store and use information about you in accordance with our Privacy & Data Protection Policy (a copy of which is available on request or otherwise available on our website at www.conveyancingnetwork.co.uk). You acknowledge and agree to be bound by the terms of our Privacy & Data Protection Policy.

Customer Charter

  1. Conveyancing Network will assess each reimbursement claim on its merits. If the Customer Charter Controller decides that the service you have received has fallen beneath the standards as published on our website at http://www.conveyancing-network.co.uk/documents/CNcharter.pdf then your File Management Fee will be reimbursed to you by your solicitor.
  2. The Customer Charter as published on our website at http://www.conveyancing-network.co.uk/documents/CNcharter.pdf is subject to change without notice. Any reimbursement claims will be subject to the details contained in the Customer Charter as published on our website at http://www.conveyancing-network.co.uk/documents/CNcharter.pdf at the time the claim is received by us.

Terms for supply of Survey Services

  1. You acknowledge that the survey fee paid by you to us for supply of surveying services is non-refundable. 
  2. Surveys are carried out by third party suppliers and we take no responsibility for their accuracy and any liability caused by their activities.

If any part of these Terms is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these Terms will not be affected.
